Statutory terms of engagement governing luxury safari reservations, licensed dangerous game outfitter expeditions, outfitter gear store sales, PCI-DSS Level 1 payments, nationwide and international courier logistics, wilderness indemnities, and consumer protections.
Statutory Information Disclosure (Section 43 ECTA 25 of 2002)
Mandatory legal and commercial particulars in compliance with the Electronic Communications and Transactions Act.
Clauses in these Terms that limit Kampvuur Safaris' liability, allocate risk to you, require strict adherence to experienced dangerous game PH safety directives in big game territory, or govern cancellation schedules on private concession bookings have been drafted in plain language and are highlighted in bold. Please review Sections 4, 6, 7, 8, 10, and 11 carefully before confirming a safari reservation or placing outfitter merchandise orders.

01.Acceptance of Terms & Contract Formation
By accessing, browsing, registering on, ordering from, or reserving expeditions through the Kampvuur Safaris website (kampvuursafaris.co.za), you enter into a legally binding contract with Kampvuur Safaris (Pty) Ltd and agree to be bound unconditionally by these Terms and Conditions (“Terms”).
These Terms incorporate by reference our Privacy Policy & POPIA Statutory Notice, custom safari booking agreements, outfitter vouchers, and wilderness indemnities. If you do not agree with any part of these Terms, you must discontinue use of this website and refrain from placing merchandise orders or booking safaris.
In terms of Section 22 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), an agreement concluded electronically between Kampvuur Safaris and a client is valid and enforceable upon electronic confirmation.
02.Use of Website & Itinerary Materials
All texts, species guides, hunting descriptions, custom safari itineraries, founder field notes, high-resolution African photography, and branding published on this platform are proprietary assets of Kampvuur Safaris:
- Permitted Use: You are granted a limited, revocable, non-exclusive license to view website itineraries and download traveler dossiers solely for your personal, non-commercial safari planning.
- Prohibited Conduct: You may not copy, scrape, reproduce, reverse-engineer, distribute, or commercially exploit any website code, species data, itinerary layouts, or wildlife photography without prior written authorization from Kampvuur Safaris.
- Ethical Respect: Kampvuur Safaris conducts all wilderness expeditions in strict accordance with fair-chase ethics, anti-poaching wildlife conservation, and provincial game laws.
03.Outfitter Merchandise & Bush Gear
Kampvuur Safaris provides field-tested expedition outfitter merchandise, including genuine leather cartridge pouches, safari bush hats, thermal campfire fleece jackets, vacuum flask sets, and 1880 Pioneer canvas duffles:
- Authentic Outfitter Materials: Our gear is crafted from durable expedition-grade materials (genuine South African leather, heavy-duty waxed canvas, and stainless steel) built to withstand the rigors of the African bush.
- Natural Leather Variations: Handcrafted leather products may feature natural markings, grain variations, and subtle tanning tone differences. These natural traits reflect genuine hide authenticity and do not constitute defects.
04.Online Shop Ordering & Pricing Accuracy
1. Order Placement & Binding Sale: Products displayed on our outfitter store constitute an invitation to do business. An order placed by you represents an offer to purchase goods. A binding sale is concluded when Kampvuur Safaris receives verified payment settlement and issues an official Order Confirmation with an assigned reference (e.g. KVS-ORD-XXXX).
2. Real-Time Inventory: If an outfitter item is temporarily out of stock following order placement, our quartermaster desk will contact you within 1 (one) business day via WhatsApp or email to provide an immediate full refund or priority dispatch upon fresh stock arrival.
3. Pricing Accuracy: While we exercise rigorous care to verify all catalog pricing, typographical or database errors may occur. Kampvuur Safaris is not legally bound to supply merchandise at an obvious or gross typographical error price. In such events, we will notify you immediately to offer confirmation at the correct price or an immediate 100% refund.
05.3D Secure Card Gateway & Direct Bank EFT
1. Currency: All prices quoted on our platform are in South African Rand (ZAR). Where applicable, prices include Value-Added Tax (VAT).
2. Online Card & Instant EFT Gateway: Online card payments (Visa, MasterCard), Instant EFT, and SnapScan for physical merchandise purchases are processed securely via authorized South African acquiring payment gateways (Payments Association of South Africa registered, PCI-DSS Level 1 certified). Under our compliance scope, online card processing is dedicated strictly to physical goods and confirmed services.

06.Nationwide & International Courier Logistics & Breakages
1. Door-to-Door & Global Delivery: Kampvuur Safaris provides tracked door-to-door courier delivery to any physical residential or commercial address across South Africa and worldwide to international destinations via premier insured express logistics and air freight networks. We do not deliver to PO Boxes.

3. Free Courier Shipping: Orders of outfitter merchandise meeting or exceeding R 1,500.00 qualify for complimentary standard door-to-door courier delivery within South Africa. International freight is calculated based on destination and volumetric weight.
4. Mandatory 48-Hour Transit Damage Protocol: If a package arrives visibly damaged:

You must notify our customer care desk within 2 (two) business days (48 hours) of delivery via WhatsApp (+27 82 761 8364) or email ([email protected]) with photographic evidence showing: (a) the exterior courier packaging, (b) the waybill label, and (c) the damaged item. Upon prompt verification, we will schedule collection and dispatch an immediate replacement within ten (10) working days at zero extra cost.
07.Shop Returns, Sizing Advisory & Statutory Consumer Rights
1. Pre-Purchase Sizing Advisory: Please contact our outfitter desk before checkout via WhatsApp (+27 82 761 8364) if you feel unsure about the fabric, styling, or sizing of our garments to avoid unnecessary return logistics.
2. Statutory 7-Day Cooling-Off Right (Section 44 ECTA): For standard outfitter merchandise purchased online, you are entitled to cancel your purchase within 7 (seven) calendar days of delivery for a full refund. The goods must be returned in their original, unused, unworn condition with all labels, badges, and packaging intact. In terms of Section 44(2) of ECTA, the customer is responsible for the direct return courier fee.
3. Faulty Garments & 10-Working-Day Replacement SLA: In the event of a garment arriving faulty or damaged, we schedule collection and replacement within 10 (ten) working days. If suitable replacement items cannot be provided, we refund your purchase at 100% of product costs.
4. Branded & Custom Garments Exclusion (CPA §20(3)(b) & ECTA §44(2)(a)): Branded items (embroidered or printed with lodge details, company crests, or personal monograms) are strictly non-returnable and non-refundable. Approval of digital design proofs confirmed with you is legally deemed final and accepted.
5. Six-Month Quality Warranty (Sections 55 & 56 CPA): All physical merchandise carries an implied statutory 6-month warranty against latent manufacturing defects. If an item fails due to defective craftsmanship within 6 months, we will repair, replace, or refund the item in full.

08.Safari Reservations, Deposits & Balance Schedules
Because private safari expeditions involve exclusive luxury lodge bookings, private concession rights, dedicated 4x4 vehicles, and licensed dangerous game Professional Hunters (PHs):
- 50% Initial Deposit: A non-refundable booking deposit of 50% of the total safari package price is required upon reservation to lock in exclusive concession dates, luxury chalet accommodations, and Professional Hunter (PH) assignments.
- Balance Payment Deadline: The remaining 50% balance must be settled in full at least 30 (thirty) days prior to the expedition departure date (South Africa Standard Time, UTC+2).
- Late Bookings: Reservations made within 30 days of the start date require 100% upfront settlement upon confirmation.
- Cancellation & Refund Schedule (CPA s17): Cancellations must be communicated in writing to
[email protected]. Due to advanced concession commitments:- 61+ days prior to departure: Deposit may be transferred to alternative available dates within 12 months (subject to seasonal price adjustments).
- 31 to 60 days prior to departure: 50% of total expedition fee forfeited.
- 30 days or fewer prior to departure: 100% of total expedition fee forfeited due to exclusive lodge block-out commitments.
09.Hunting Ethics, Permits & Firearms Compliance
As a licensed South African hunting outfitter specializing in dangerous African game:
- Fair-Chase Ethics: All hunts are conducted on foot in strict compliance with fair-chase conservation principles and provincial hunting regulations.
- Permits & Licenses: All government hunting permits, TOPS permits (Threatened or Protected Species), and CITES documentation must be secured prior to the hunt. Trophy fees are payable in accordance with the confirmed outfitter agreement.
- Firearms Safety & SAPS Importation: Clients bringing their own rifles or black powder firearms must possess valid temporary SAPS 520 firearm permits and adhere to safe handling and field commands at all times.
10.Wilderness Safety & Inherent Field Risks
Mandatory Field Safety Invariant — Professional Hunter (PH) Authority:
While on hunting tracks, guided bush walks, tracking big game, or participating in 4x4 game drives, THE LICENSED PROFESSIONAL HUNTER (PH) HAS ABSOLUTE, UNCHALLENGED AUTHORITY ON ALL MATTERS OF SAFETY AND FIREARMS DISCHARGE. In accordance with South African hunting regulations, only a licensed Professional Hunter may escort international hunting clients in the field. Guests must obey all verbal commands immediately without hesitation (including instructions to freeze, make safe, retreat, take cover, or remain inside the vehicle). Failure to comply with safety directives authorizes the Professional Hunter to terminate the hunting or field activity immediately to preserve human life.
- Comprehensive Travel & Medical Evacuation Insurance: All international safari guests are strictly required to possess comprehensive international travel insurance that includes emergency wilderness medical evacuation coverage (e.g. Medevac / helicopter evacuation).
- Campfire & Boma Safety: Campfires and boma areas involve open flames and wild bush surroundings. Guests must exercise caution near open hearths and never wander unescorted outside unfenced lodge perimeters after dark.
11.Limitation of Liability & Guest Indemnity (CPA s49)
To the maximum extent permitted by Section 51 of the Consumer Protection Act 68 of 2008 and South African law:
1. Inherent Wilderness Hazards: African safari expeditions, walking safaris, and dangerous game encounters involve inherent natural hazards, including encounters with wild animals (lions, elephants, buffalo, leopards, snakes), uneven terrain, river crossings, extreme weather, and remote locations where emergency medical facilities are hours away. Guests voluntarily accept these inherent wilderness risks.
2. Exclusion of Indirect Damages: Kampvuur Safaris, its directors, professional hunters, trackers, lodge staff, and concession owners shall not be liable for any indirect, special, incidental, punitive, or consequential damages, including missed international flight connections, weather delays, or lost personal equipment.
3. Total Monetary Liability Cap: In all circumstances, Kampvuur Safaris' total aggregate liability arising out of any safari reservation or merchandise sale, whether in contract, delict, or otherwise, shall be strictly capped at the total amount actually paid by you for the specific booking or order giving rise to the claim.
4. Written Concession Indemnity: Prior to departing on any safari activity, all guests must sign the official Kampvuur Safaris Written Concession Indemnity Form.
12.Governing Law, Dispute Resolution & Domicilium
1. Governing Law: These Terms and all expeditions and sales concluded through this website shall be governed by and interpreted exclusively in accordance with the laws of the Republic of South Africa.
2. Amicable Resolution & Ombudsman: In the event of any query or dispute, you are encouraged to contact our operations desk at [email protected], via phone at +27 82 761 8364, or via WhatsApp at +27 82 761 8364. We commit to resolving concerns amicably within 5 (five) business days. If unresolved, consumers retain the right to escalate matters to the Consumer Goods and Services Ombud (CGSO).
3. Expedited Commercial Arbitration: Any dispute that cannot be resolved amicably shall be submitted to confidential, binding arbitration administered by the Arbitration Foundation of Southern Africa (“AFSA”) under its Expedited Rules, conducted in Pretoria or Johannesburg.
4. Domicilium Citandi et Executandi: Kampvuur Safaris chooses as its domicilium for all formal legal notices and communications:
